Microsoft Appeal Put on Fast Track

The judge who ruled Microsoft Corp. maintains an illegal monopoly on
computer operating software wants to ``fast track'' the appeal directly
to the Supreme Court to avoid delays that could ``disrupt the economy,''
according to a court transcript. During a private meeting Tuesday in his
chambers, U.S. District Judge Thomas Penfield Jackson told lawyers for
all the parties that he wanted to complete the remedy phase of the trial
within 60 days. He indicated he might refer the case directly to the
U.S. Supreme Court even before that phase began.

House Acts to Reject Rules on Transplants

The House voted yesterday to overturn new federal rules aimed at making
sure that the sickest patients get the first chance to use donated
organs, as lawmakers debated how best to share the scarce resources and
save the most lives.

North Carolina sets cap to shield tobacco company assets

The North Carolina legislature in a one-day special session on Wednesday
moved to shield tobacco company assets from a potentially financially
crippling jury award in a Florida class-action lawsuit. The state General
Assembly set a $25 million cap on the amount of bonds that tobacco
companies would have to post in the state while appealing the landmark
Engle lawsuit filed on behalf of about one million ill smokers in
Florida.

Sears OKs Sabbath Observers Deal

Sears, Roebuck & Co. has agreed to a settlement that allows repair
workers who have religious objections to working on Saturdays to work
Sundays instead. New York Attorney General Eliot Spitzer - who had
threatened to sue Sears - said the giant retail company also agreed to
pay $225,000 for employer education programs, $120,000 in training
scholarships for Sabbath observers and $100,000 to cover the cost of his
investigation.

Judge: Prayer OK in U.S. Capitol
FindLaw News

A federal judge on Tuesday upheld a Maryland preacher's First Amendment
right to pray inside the U.S. Capitol. U.S. District Court Judge Paul.
Friedman ruled that the Capitol Police have no authority to stop people
from making speeches or engaging in other nondisruptive forms of
behavior.

America Online sued by small rival over ``monopoly''

A small Internet service provider sued America Online (AOL) Tuesday,
accusing the media giant of trying to use its latest software to
monopolize the Internet market and stifle competition. Galaxy Internet
Services Inc. of Newton, Mass. sued America Online in federal court in
Boston, charging that AOL 5.0, the version of its software launched in
October, blocks its subscribers from using other Internet service
providers.

Court Says Computer Programming Languages Are Protected by First
Amendment

Computer programs used to scramble electronic messages are protected by
the First Amendment because those codes are a means of communication
among programmers, a federal appeals court ruled Tuesday. Raymond
Vasvari, legal director of the American Civil Liberties Union of Ohio,
said the ruling was the first time a federal appellate court has decided
that computer programming languages are protected by the First
Amendment.

Two From LAPD Indicted in Alleged Framing of Suspect

A federal grand jury on Wednesday indicted one current and one former
officer from the Los Angeles Police Department's 77th Street Division,
alleging they violated a man's civil rights five years ago by falsely
claiming he had a concealed weapon. The indictment was handed down while
authorities continue to probe more recent allegations of misconduct,
criminality and civil rights violations centered in the LAPD's Rampart
Division. Involving, as it does, alleged misconduct outside Rampart,
Wednesday's indictment could have significant implications for the U.S.
Department of Justice's ongoing pattern and practice investigation of
civil rights abuses stemming from organizational shortcomings at the
LAPD.

Former Couple Battles for Custody of Rottweiler
Los Angeles Times


At the center of an offbeat custody battle is Guinness, a 123-pound
Rottweiler named for the potent Irish brew. Last year, when the couple
that cared for the dog broke up, Guinness stayed at Patti Dalby's
Newport Beach house, where he romps in a huge yard. But C. Brooks Brann,
Dalby's former boyfriend, misses his "best friend and loyal companion"
and wants the animal flown to his new home in Montana.

Nike Sued Over Shoelace

A Manhattan orthopedic surgeon sued Nike Inc. on Wednesday for $10
million, saying shoes made by the athletic footwear giant tripped her
and caused permanent injury. Dr. Deborah A. Faryniarz filed the lawsuit
in U.S. District Court in Manhattan, alleging she sustained serious and
permanent injuries when she fell last April 8 while jogging. According
to the lawsuit, the right shoelace hooked around the back tab of the
left sneaker, spilling her onto her wrists and knees.
