SEA HAWK v. ALYESKA (3/16/00 - No. 9835807-9th Circuit Opinions)
Bailiff’s inappropriate ex parte contact with one juror, and another juror’s
account of bailiff’s threats and intimidation, were not irregularities
sufficient to warrant vacating punitive damages award in Exxon Valdez oil
spill litigation, as ex parte contact was not coercive and account of
threats and intimidation did not merit belief.

GOVERNMENT LAW

DEBOER v. CITY OF BELLINGHAM (3/17/00 - No. 9735363)
City and state officials were not entitled to qualified immunity for
entering city-owned premises and seizing government contractor’s records and
property based on agreement that financial records would be made available
to city and other government agencies with jurisdiction for audit purposes.

SIMON v. VALUE BEHAVIORAL (3/17/00 - No. 9855905)
Plaintiff lacked standing to sue under ERISA, antitrust law and RICO, since
as an assignee of health care providers that were in turn assignees of
patients’ benefit claims he was neither a participant nor a beneficiary of
any of the plans under which his claims arose.
