ENVIRONMENTAL LAW

BOEING v. CASCADE (3/24/00 - No. 9635246)
Under CERCLA, when a party is responsible for hazardous substance response
costs, it must share them regardless of whether it was the sole cause of
those costs. Court may use volume to allocate response costs between
co-polluters if there is sufficient evidence presented to allow for a
reasonable approximation of each defendant’s contribution to the
contamination.

Judge denied alien applying for asylum and withholding of deportation the
right to counsel by excluding seven lawyers as possible future counsel and
forcing an attorney with no understanding of her case to represent her.

WEBB v. NATIONAL UNION FIRE (3/24/00 - No. 9935303)

Insurance company was prohibited from introducing extrinsic evidence to
prove that it did not provide coverage for a plane crash since insurance
policy was not ambiguous on its face.
