BANKRUPTCY LAW, LABOR & EMPLOYMENT LAW
LEONARD v. ST. ROSE DOMINICAN HOSP., No. 01-15544 (9th Cir. November
13, 2002)

Because the anti-discrimination provision of the Bankruptcy Code, 11
U.S.C. section 525(b), does not protect persons who have not yet
filed for bankruptcy, a doctor who was fired before filing for
bankruptcy could not seek protection from the termination under that
statute.

PATEL v. CITY OF SAN BERNARDINO, No. 01-55280 (9th Cir. November 13,
2002)

Pravin D. Patel and twenty other named plaintiffs sued the
city of San Bernardino, California for damages stemming
from the city’s enforcement of an unlawful tax. The district
court dismissed the complaint for lack of jurisdiction. We
affirm in part, reverse in part, and remand.

A 42 U.S.C. section 1983 claim for damages, arising from a city's
enforcement of an unlawful tax imposed on hotel guests, may proceed
in federal court to the extent it seeks damages accrued after a
state court overturned the tax.
