HATCHER v. BARNHART, No. 03-3459 (8th Cir. May 28, 2004)

Administrative Law Judge erred in disregarding the opinion of
claimant's treating physician, and the case is remanded for further
proceeding in conformity with Cox v. Barnhart, 345 F.3d 606 (8th
Cir. 2003).

EDEN ELEC. v. AMANA CO., L.P., No. 03-2123; 03-2188 (8th Cir. May

28, 2004)
The district court did not err in instructing the jury on fraudulent
misrepresentation and imputation of an agent's actions to its
principal, nor did they err in reducing the punitive damages award.

US v. MARTIN, No. 03-2007 (8th Cir. May 28, 2004)

Statements cross-appellee gave to FBI agents were admissible in
prosecution as the statements were voluntarily made because he was
not in custody at the time he made the statements, and the agents'
failure to read him his Miranda rights did not render the statements
inadmissible.

US v. ELK, No. 03-3069 (8th Cir. May 28, 2004)
The district court did not err in applying a cross-reference in the
United States Sentencing Guidelines manual, in applying a two-level
sentencing enhancement for obstructition of justice, nor in denying
defendant's motion for a new trial.
